Abstract

This research addresses the thirty-five-year milestone of the 1988 Federal Constitution, based on the theme of the effectiveness of constitutional norms, that is, the implementation of the Constitution. The study deals mainly with the possibility of participatory and emancipatory citizenship, at the same time that it offers a viable defense of the procedural character of the Federal Constitution, through the legal-political philosophy of Jürgen Habermas together with the help of secondary literature. To this end, the text is divided into four parts, with the first section dealing with the limits and possibilities of implementing the 1988 Constitution; the second section discusses the role of Philosophy of Law in the neoconstitutional panorama; the third section presents the idea of complementarity between morals, law and politics; finally, the fourth section reflects on the contribution of deliberative democracy to the theory of the constitution. The conclusion points, in general, to the theoretical-critical potential of Habermas' discursive theory, as a theory capable of offering legitimacy to positive Law, at the same time that it enables the implementation of the Constitution through the participation of those concerned, in a model of constitutional jurisdiction committed to emancipatory citizenship and the country's socio-political development.

Adjunct Professor at the University of Passo Fundo, School of Legal Sciences. PhD in Legal and Social Sciences from the Fluminense Federal University; Master in Development from the Regional University of the Northwest of the State of Rio Grande do Sul; Master in Philosophy from the Federal University of the Southern Border; graduated in Legal and Social Sciences and in Philosophy from the University of Passo Fundo, in Theology from the Uninter University Center, and in Philosophy from the Cidade Verde University Center.
