Política de concorrência e desenvolvimento: reflexões sobre a defesa da concorrência em uma política de desenvolvimento

Resumo


A agenda de intervenção econômica market friendly, inspirada pelo Consenso de Washington, implementada no Brasil e em outros países na década de 1990, teve entre seus fundamentos a ideia de que a qualidade das instituições é relevante para o desenvolvimento econômico.1 Como parte dessa agenda, foi criado no Brasil, através da Lei 8.884-94, um marco jurídico para a política brasileira de Defesa da Concorrência. Esta legislação, interpretada pelas decisões do Conselho de Defesa Econômica (Cade), tem servido de guia para a intervenção do Estado brasileiro na ordem econômica com o objetivo de manter o ambiente concorrencial, estabelecendo travas para fusões e aquisições no Brasil e reprimindo atividades consideradas anticoncorrenciais.
